1. Acceptance of Terms

By accessing or using extensionbyfort.com (the “Site”), or by placing an order for any products
(including but not limited to French Curls, Nu-Locs, Passion Twists, Gypsy Locs, and Fortorganics skincare),
you agree to be bound by these Terms and Conditions (“T&C”).

If you do not agree to these T&C, you must not use our Site or purchase our products.

These T&C apply to all users, visitors, vendors, and customers.

2. Eligibility

You may only use this Site if:

• You are at least 18 years of age, or
• You are a minor (under 18) using the Site with the consent and supervision of a parent or legal guardian.

By placing an order, you represent that you are lawfully able to enter into binding contracts under Nigerian law.

3. Products and Pricing

3.1 Product Descriptions

We make every effort to display our hair extensions and skincare products as accurately as possible (including texture, colour, and length). However, due to differences in monitor displays, lighting during photography, or natural variations in raw materials (e.g., shea butter colour variations), we cannot guarantee that the product you receive will exactly match the image shown.

3.2 Pricing

All prices on extensionbyfort.com are listed in Nigerian Naira (NGN) unless otherwise specified.

• Prices include Value Added Tax (VAT) as required by the Federal Inland Revenue Service (FIRS) .
• Delivery fees (shipping) are calculated at checkout and are not included in the product price unless a “Free Shipping” promotion is explicitly stated.

3.3 Errors

We reserve the right to correct any pricing errors, inaccuracies, or omissions. If we discover a pricing error after you have placed an order, we will contact you immediately to either cancel the order or confirm the corrected price before processing payment.

4. Orders and Acceptance

4.1 Placing an Order

When you place an order, you receive an automated email confirmation. 
This does not mean your order has been accepted. It is merely an acknowledgment that we have received your request.

4.2 Order Acceptance

Your order is only accepted when:

1. We have successfully verified your payment (via Flutterwave, Paystack, or bank transfer), and
2. We send you a Dispatch Confirmation email that includes your tracking number.

We reserve the right, at our sole discretion, to refuse or cancel any order for reasons including but not limited to:

• Product unavailability,
• Suspected fraud,
• Pricing errors,
• Inability to verify shipping address (especially for deliveries outside Lagos or international orders).

4.3 Right to Cancel (Before Dispatch)

You may cancel your order without penalty before we have issued a Dispatch Confirmation.
To cancel, email us immediately at orders@extensionbyfort.com with your order number.

Once a Dispatch Confirmation is sent (i.e., the product has left our Alagbado warehouse),
the cancellation window closes, and our Return & Refund Policy applies.

5. Payment Methods

We accept the following secure payment methods:

• Cards: Visa, Mastercard, Verve (processed via Flutterwave/Paystack)
• Bank Transfers: Direct transfer to our designated The Fort Brand Limited account (details provided at checkout)
• USSD/Quickteller (for Nigerian customers without cards)

Note: We do not store your full card details on our servers. All payment processing is PCI-DSS compliant via our third-party payment gateways.

6. Delivery, Shipping & Risk

6.1 Delivery Areas

We currently ship to:

• All 36 states of Nigeria + FCT Abuja (via GIG Logistics, UPS, or local couriers)
• International (UK, USA, Canada, and selected European countries)

6.2 Delivery Timelines (Estimates)

• Lagos Metro (e.g., Alagbado, Ikeja, VI): 1–3 business days
• Other Nigerian states: 3–7 business days
• International: 7–14 business days (subject to customs clearance)

These are estimates, not guarantees. We are not liable for delays caused by courier companies, bad weather, port congestion, or Nigerian customs inspections.

6.3 Risk and Title

Risk of loss or damage to the products passes to you as soon as the courier picks up the parcel from our warehouse.
However, legal title (ownership) remains with The Fort Brand Limited until we have received full payment (cleared funds) for the order.

6.4 Failed Delivery

If a courier attempts delivery but you are unavailable, they will leave a notification.
If you fail to arrange re-delivery or pick-up within 7 days, the parcel will be returned to our warehouse. You will be responsible for the cost of re-shipping.

7. Returns, Refunds, and Exchanges (The “Fort Guarantee”)

Because we sell hair extensions and Hair products (which are intimate/hygiene-sensitive), our returns policy is stricter than general merchandise.

7.1 Non-Returnable Items (For hygiene & safety)

The following cannot be returned or exchanged unless they arrived damaged or defective:

• Wigs, lace closures, frontal units (once the adhesive seal is broken)
• Braiding hair, pre-stretched hair (once the pack is opened)
• Skincare products (creams, oils, butters) that have been used or opened
• Earrings (due to piercing hygiene)

7.2 Returnable Conditions (30 Days)

You may request a return within 30 days of delivery only if:

• The product is unused, unopened, and in its original packaging (including seals, tags, and boxes).
• You provide a valid receipt or order number.

Return shipping costs are borne by the customer unless the product was defective or we sent the wrong item.

7.3 Damaged or Wrong Items

If you receive a product that is damaged, defective, or not what you ordered:

• You must notify us within 48 hours of delivery.
• Send photos and your order number to returns@extensionbyfort.com.
• We will arrange a free return (send a courier to your address) and either:
  

  • Send a replacement (at no cost), or
  • Issue a full refund (including original shipping fees).

7.4 Refunds

Approved refunds will be processed within 7–10 business days via the original payment method
 (e.g., card reversal or bank transfer). Bank processing times may add additional delays outside our control.

8. Prohibited Conduct

When using our Site, you agree not to:

• Use any robot, spider, scraper, or other automated means to access our Site for any purpose without our express written permission.
• Attempt to interfere with the security or functionality of the Site.
• Purchase our products for resale without a separate wholesale agreement with The Fort Brand Limited.
• Post false or misleading reviews.

9. Intellectual Property

All content on extensionbyfort.com — including but not limited to:

• Product photographs,
• Descriptions (“French Curls,” “Gypsy Locs,” “Nu-Locs”),
• Logos (the “Fort” brand mark),
• Website code and layout

— is the exclusive property of The Fort Brand Limited and is protected under
Nigerian copyright law (Copyright Act, Cap C28 LFN 2004) and international treaties.

You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by Nigerian law:

• We are not liable for any indirect, incidental, or consequential damages
  (e.g., lost profits, damaged reputation, or allergic reactions to our organic skincare products) arising from your use of our products or Site.
• Our total liability to you for any claim arising from a product purchase shall not exceed the amount you paid for that specific product.

Exception: Nothing in this section limits our liability for death, personal injury caused by our negligence, or fraud.

11. Indemnification

You agree to indemnify and hold harmless The Fort Brand Limited,
its directors, employees, and affiliates from any claims, losses, damages, or expenses (including legal fees) arising out of:

• Your breach of these T&C,
• Your misuse of our products (e.g., improper application of hair glue leading to scalp injury),
• Your violation of any third-party rights.

12. Force Majeure

We shall not be held liable for any delay or failure to perform our obligations
 (including delivery) if such delay or failure results from events beyond our reasonable control, including but not limited to:

• Acts of God (floods, earthquakes),
• Governmental actions (lockdowns, border closures),
• Internet or power outages,
• Strikes by courier companies.

13. Dispute Resolution and Governing Law

13.1 Governing Law

These T&C and any dispute arising from your use of extensionbyfort.com s
hall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

13.2 Dispute Resolution Process (Mandatory Before Litigation)

1. Formal Complaint: You must first send a written complaint describing
   the issue to legal@extensionbyfort.com. We will respond within 14 business days.
2. Mediation: If we cannot resolve the dispute internally, either party may request
   mediation through the Lagos Multi-Door Courthouse (LMDC) or an accredited arbitration centre in Lagos.
3. Arbitration: If mediation fails, the dispute shall be finally resolved by binding arbitration in Lagos,
    Nigeria under the Arbitration and Conciliation Act, Cap A18 LFN 2004. The arbitration shall be conducted by a single arbitrator mutually agreed upon.
4. Small Claims: For disputes involving less than ₦500,000, either party may bring an action in the 
   Magistrate Court of Lagos State without first going through arbitration.

13.3 Consumer Protection

Nothing in this section limits your right to lodge a complaint with the Federal Competition and Consumer Protection Commission (FCCPC) at www.fccpc.gov.ng.

14. Amendments to These Terms

We may update these T&C from time to time (e.g., when we introduce new products like
“Fort Beauty Academy” or change shipping partners). The “Last Updated” date at the top of this page will reflect the change.

Your continued use of the Site after any amendment constitutes your acceptance of the revised T&C. If you do not agree, you must stop using the Site.

15. Severability

If any provision of these T&C is held to be invalid, illegal, or unenforceable by
 a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These T&C, together with our Privacy Policy and Shipping & Returns Policy,
constitute the entire agreement between you and The Fort Brand Limited regarding
your use of extensionbyfort.com and supersede all prior agreements, representations, or understandings.
